Le concept de la franchise repose sur une \u00e9troite collaboration entre le franchiseur et ses franchis\u00e9s. Ce concept impose au franchiseur l’obligation de transmettre son savoir-faire \u00e0 ses franchis\u00e9s. Un savoir-faire \u00e9prouv\u00e9 qui va leur permettre de se d\u00e9velopper. Il a \u00e9galement l’obligation de les accompagner et de leur apporter toute l’assistance et les outils n\u00e9cessaires \u00e0 leur d\u00e9veloppement.<\/p>\n

Remi De Balmann<\/strong> : \u00ab Je crois qu’il faut avoir \u00e0 l’id\u00e9e que le franchiseur n’est en aucun cas d\u00e9biteur d’une obligation de r\u00e9sultat \u00e0 l’\u00e9gard d’un candidat franchis\u00e9<\/strong>. Personne ne peut pr\u00e9juger du succ\u00e8s d’une franchise dans la mesure o\u00f9 tout repose – et cela les juges sont l\u00e0 pour le rappeler s’il en \u00e9tait besoin – d’abord et avant tout sur les comp\u00e9tences personnelles du franchis\u00e9, sur ses qualit\u00e9s commerciales, sur son adaptabilit\u00e9 et sur son sens ou non des affaires.<\/div>\n<\/div>\n<\/div>\n

Ceci \u00e9tant pr\u00e9cis\u00e9, il est un fait aussi qu’il appartient \u00e0 un franchiseur de s\u00e9lectionner les candidats. Le code europ\u00e9en de d\u00e9ontologie de la franchise \u00e0 cet \u00e9gard indique que les franchiseurs ne doivent recruter que des personnes dont les comp\u00e9tences sur les plans \u00e0 la fois financier, humain et personnel font qu’ils apparaissent comme dignes et susceptibles d’\u00eatre de bons franchis\u00e9s.<\/p>\n<\/div>\n<\/div>\n<\/div>\n

Le franchiseur n’a pas d’obligation de r\u00e9sultat mais de moyens<\/h2>\n

La formation interviendra apr\u00e8s la signature du contrat de franchise. Donc nous ne pouvons pas pr\u00e9juger des qualit\u00e9s, des capacit\u00e9s r\u00e9elles d’un franchis\u00e9 en disant que\u00a0finalement cette formation ne lui a pas \u00e9t\u00e9 profitable ! Nous ne sommes pas d’ailleurs \u00e0 cet \u00e9gard, dans une relation salariale o\u00f9 il peut exister des p\u00e9riodes d’essai. Nous int\u00e9grons quelqu’un dans l’entreprise et puis, si jamais le courant ne passe pas, nous pouvons nous en s\u00e9parer sans trop de d\u00e9g\u00e2ts. Alors qu’inversement, lorsqu’un franchis\u00e9 a sign\u00e9 son contrat, nous sommes li\u00e9s par le lien contractuel.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n

C’est pourquoi il est de bonne politique – et c’est \u00a0bien \u00e9videmment\u00a0ce que\u00a0nous pr\u00e9conisons aux futures t\u00eates de r\u00e9seau que nous accompagnons dans leur d\u00e9veloppement – d’int\u00e9grer un candidat franchis\u00e9 dans le r\u00e9seau, ne serait-ce qu’une journ\u00e9e \u00e0 l’occasion d’un stage d\u00e9couverte qui va lui permettre sur un point de vente donn\u00e9, de voir si effectivement ou pas, il va marquer un int\u00e9r\u00eat et un attachement pour l’activit\u00e9 qu’il indique vouloir adopter.<\/p>\n<\/div>\n<\/div>\n<\/div>\n

Il peut arriver qu’\u00e0 l’occasion d’un tel stage d\u00e9couverte, le candidat lui-m\u00eame r\u00e9alise qu’en r\u00e9alit\u00e9, il a pu \u00eatre s\u00e9duit par l’enseigne, par un certain nombre d’\u00e9l\u00e9ments mais que l’activit\u00e9 elle-m\u00eame ne lui convient finalement pas tant que cela.<\/p>\n<\/div>\n<\/div>\n<\/div>\n

Pour r\u00e9pondre \u00e0 la question sur cette formation, le franchiseur en est-il responsable en engageant sa responsabilit\u00e9 qui ferait que le franchis\u00e9 doit r\u00e9ussir imp\u00e9rativement ? Ma r\u00e9ponse est non. Mais je la nuance en disant aussi, et c’est l’\u00e9vidence, que la formation doit elle-m\u00eame \u00eatre destin\u00e9e \u00e0 permettre \u00e0 tout candidat quel qu’il soit, quels que soient son parcours et sa personnalit\u00e9 d’acc\u00e9der \u00e0 ce savoir-faire. Il faut des outils qui permettent au candidat franchis\u00e9 une fois son contrat sign\u00e9, d’avoir le sentiment que le franchiseur lui permet d’aborder sereinement l’activit\u00e9 nouvelle qui va \u00eatre la sienne.<\/p>\n<\/div>\n<\/div>\n<\/div>\n

Faut-il d\u00e8s lors aussi \u00e0 cet \u00e9gard l’adapter. Il va y avoir des s\u00e9ances de formation qui vont r\u00e9unir un certain nombre de franchis\u00e9s. Mais il est assez \u00e9vident qu’il ne faut pas que ce soit des cours ex cathedra, quelque chose d’extr\u00eamement th\u00e9orique. Il faut qu’il y ait une interactivit\u00e9, il faut que le franchiseur lui-m\u00eame se soucie de voir que cette formation soit bien int\u00e9gr\u00e9e. <\/strong>Et si jamais le franchis\u00e9 d’ailleurs lui-m\u00eame au bout de la semaine ou les quinze jours de formation, ne semble pas avoir les capacit\u00e9s pour d\u00e9marrer l’activit\u00e9, il faut qu’\u00e0 ce moment r\u00e9it\u00e9rer, renouveler la formation jusqu’\u00e0 ce que le concept soit bien int\u00e9gr\u00e9.<\/p>\n<\/div>\n<\/div>\n<\/div>\n

Qu’en dirait le juge ?<\/h2>\n

Un juge pourrait avoir tendance \u00e0 consid\u00e9rer qu’un franchiseur venant lui dire que cette formation n’a pas march\u00e9 avec tel personne, aurait ce sentiment qu’elle n’\u00e9tait pas finalement elle-m\u00eame l’objet d’outil de transmission suffisamment rod\u00e9. Nous pourrons dans une telle hypoth\u00e8se inversement retourner l’argument en disant que si la majorit\u00e9 des franchis\u00e9s appr\u00e9cient – et correctement plac\u00e9e sur orbite au terme de la formation initiale – celui qui se serait montr\u00e9 r\u00e9fractaire \u00e9tait finalement en quelque sorte un cas particulier !<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n

Mais encore une fois, il faut essayer de faire en sorte de bien s’adapter \u00e0 chaque cas et si vraiment au final le franchiseur constate qu’il n’y a pas de possibilit\u00e9s et de pr\u00e9jug\u00e9s d’un succ\u00e8s dans l’entreprise franchis\u00e9e, je crois qu’il faut essayer \u00e0 ce moment l\u00e0, de se mettre autour d’une table et de convenir avec le franchis\u00e9 des difficult\u00e9s pour pouvoir \u00e9viter d’aller trop loin dans une relation qui serait ensuite alt\u00e9r\u00e9e.
