Elle rassure, elle semble apporter la s\u00e9curit\u00e9, pourtant elle ne procure pas le droit automatique au renouvellement du contrat de franchise. Comment \u00e7a marche ? Le principe est la poursuite de la relation contractuelle sans formalit\u00e9.<\/b> Mais il suffit d’une lettre recommand\u00e9e A\/R du franchiseur ou du franchis\u00e9 demandant la rupture de contrat pour que celui-ci ne soit pas renouvel\u00e9, en respectant un simple pr\u00e9avis. Aucun motif ne doit \u00eatre avanc\u00e9, la seule limite qui puisse \u00eatre \u00e9voqu\u00e9e, selon certains arr\u00eats de la Cour de Cassation, est l’abus de droit ou la rupture brutale, apr\u00e8s avoir laiss\u00e9 esp\u00e9rer le renouvellement du contrat de franchise. Il n’y a donc pas plus de protection avec une clause de tacite reconduction.<\/div>\n<\/p><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<\/p><\/div>\n

En fait cette clause comporte un risque pour le franchis\u00e9 comme pour le franchiseur.<\/em><\/strong>\u00a0 Cette clause peut cr\u00e9er un climat d’ins\u00e9curit\u00e9 pour le franchis\u00e9. L’unique int\u00e9r\u00eat est qu’il continue de b\u00e9n\u00e9ficier des conditions juridiques et financi\u00e8res de l’ancien contrat, ce qui est d\u00e9j\u00e0 correct. Quant au franchiseur il n’est pas certain de fid\u00e9liser son franchis\u00e9. Mais n’est-ce pas cette incertitude que le franchiseur comme le franchis\u00e9 veulent en signant le contrat ? Ne veulent-ils pas pouvoir quitter le r\u00e9seau ou ne pas renouveler avec un franchis\u00e9 m\u00e9diocre ? <\/div>\n<\/p><\/div>\n<\/p><\/div>\n

D\u00e8s lors, l’essentiel est que la dur\u00e9e du contrat avant renouvellement par tacite reconduction soit suffisante pour rentabiliser les investissements de chacun. Il appartient ensuite \u00e0 chacun d’\u00eatre assez bon pour que l’autre veuille continuer.<\/strong> <\/div>\n<\/p><\/div>\n<\/p><\/div>\n
