Les lois r\u00e9gissant la franchise en Tunisie<\/h3>\n
Certaines lois et r\u00e9glementations ont \u00e9t\u00e9 \u00e9labor\u00e9es afin de promouvoir le secteur et d’encourager les investisseurs \u00e9trangers. (Note d’AC Franchise : ce n’est pas exactement cela. La loi et le d\u00e9cret visent \u00e0 permettre aux franchis\u00e9s tunisiens de contracter avec des franchiseurs \u00e9trangers mais dans certains m\u00e9tiers seulement) <\/i>Elles ont pour objectifs d’assurer une plus grande transparence entre le franchiseur et le franchis\u00e9<\/b> et de cerner les obligations et les droits de chaque partie<\/b>. L’Article 14 de la Loi n\u00b0 2009-69 du 12 ao\u00fbt 2009, relative au commerce de distribution, d\u00e9finit le r\u00f4le du contrat de franchise en pr\u00e9cisant que ce dernier est un contrat par lequel le propri\u00e9taire d\u2019une marque ou d\u2019une enseigne commerciale accorde le droit de son exploitation \u00e0 une personne physique ou morale d\u00e9nomm\u00e9e franchis\u00e9,<\/b> et ce, dans le but de proc\u00e9der \u00e0 la distribution de produits ou \u00e0 la prestation de services moyennant une redevance. Le droit d\u2019exploitation de la franchise comprend le transfert des connaissances acquises, le savoir faire et l\u2019exploitation des droits de la propri\u00e9t\u00e9 intellectuelle.<\/p>\n

Le D\u00e9cret n\u00b0 2010-1501 du 21 juin 2010, vient fixer les clauses minimales obligatoires des contrats de franchise ainsi que des donn\u00e9es minimales du document d’information l’accompagnant et relatives au franchiseur et de son secteur d’activit\u00e9.<\/div>\n<\/div><\/div>\n<\/p><\/div>\n<\/p><\/div>\n

Les secteurs autoris\u00e9s en Tunisie pour les franchises \u00e9trang\u00e8res <\/h3>\n
\n
Contrairement aux enseignes  nationales –  autoris\u00e9es \u00e0 franchiser quel que soit leur secteur d’activit\u00e9 –  seules les  franchises \u00e9trang\u00e8res se d\u00e9veloppant dans certains secteurs peuvent s’implanter dans le pays sans avoir besoin d’une  autorisation  pr\u00e9alable du Minist\u00e8re du Commerce et de l’Artisanat.<\/b> Parmi ces secteurs : <\/p>\n<\/div>\n

Les avantages de la franchise<\/h3>\n
\n
Il est \u00e9vident que la franchise pr\u00e9sente plusieurs avantages aussi bien pour les  franchiseurs que pour les  franchis\u00e9s.  Ces derniers vont pouvoir b\u00e9n\u00e9ficier de la notori\u00e9t\u00e9 d’une marque (souvent) d\u00e9j\u00e0 connue<\/b>, et surtout d’un concept qui a fait ses preuves,  du savoir-faire et de l’expertise du franchiseur,<\/b> des outils et des process \u00e9labor\u00e9s et mis en place par ce dernier,  d’un march\u00e9 d\u2019ores et d\u00e9j\u00e0 acquis<\/b>, (Note d’AC Franchise : cette id\u00e9e d’un march\u00e9 acquis est \u00e0 remplacer par l’id\u00e9e d’un marche plus facile \u00e0 conqu\u00e9rir)<\/i> sans oublier la formation et l’accompagnement qui restent les atouts majeurs de ce mod\u00e8le de commerce en r\u00e9seau<\/b>.   <\/p>\n

Tous ces avantages  r\u00e9duisent les risques d\u2019\u00e9chec. D’ailleurs, selon certains : \u00ab 80% des petites entreprises font faillite les deux premi\u00e8res ann\u00e9es de leur existence contre 10% pour une franchise. En moyenne, le temps pour qu\u2019un commerce ind\u00e9pendant devienne \u00e9conomiquement et financi\u00e8rement rentable, est n\u00e9cessairement de 2 \u00e0 5 ans, tout d\u00e9pend du genre de commerce. Pour une nouvelle franchise, la dur\u00e9e de rentabilit\u00e9 financi\u00e8re moyenne est de l\u2019ordre de 6.6 mois<\/b> \u00bb.
