Recrutement, publicit\u00e9 et divulgation <\/strong><\/p>\n<p>3.1. La publicit\u00e9 pour le recrutement de franchis\u00e9s doit \u00eatre d\u00e9pourvue de toute ambigu\u00eft\u00e9 et d&rsquo;informations trompeuses. <\/p>\n<p>3.2. Tout document publicitaire faisant appara\u00eetre directement ou indirectement des r\u00e9sultats financiers pr\u00e9visionnels du franchis\u00e9 devra \u00eatre objectif et v\u00e9rifiable. <\/p>\n<p>3.3. Afin que le futur franchis\u00e9 puisse s&rsquo;engager en toute connaissance de cause, le franchiseur lui fournira une copie du pr\u00e9sent Code de d\u00e9ontologie ainsi qu&rsquo;une information compl\u00e8te et \u00e9crite concernant les clauses du contrat de franchise &#8211; ceci dans un d\u00e9lai raisonnable avant la signature du contrat (10). <\/p>\n<p>3.4. Lorsque le franchiseur propose la signature d&rsquo;un contrat de r\u00e9servation, celui-ci respecte les principes suivants : <br \/>a). avant la signature de tout contrat de r\u00e9servation, le futur franchis\u00e9 doit se voir remettre les informations \u00e9crites quant au contenu de ce contrat ainsi qu&rsquo;aux d\u00e9penses qui en d\u00e9couleront pour le candidat,<br \/>b). si le contrat de franchise est sign\u00e9, les d\u00e9bours seront rembours\u00e9s par le franchiseur ou \u00e0 valoir sur le droit d&rsquo;entr\u00e9e s&rsquo;il y a lieu, <br \/>c). la dur\u00e9e du contrat de r\u00e9servation doit \u00eatre pr\u00e9cis\u00e9e, <br \/>d). une clause de d\u00e9dit r\u00e9ciproque doit \u00eatre pr\u00e9vue,<br \/>e). le franchiseur peut imposer une clause de non-concurrence et de confidentialit\u00e9 afin d&#8217;emp\u00eacher le d\u00e9tournement du savoir-faire transmis pendant la dur\u00e9e du contrat de r\u00e9servation. <\/p>\n<p><strong>4.
